From the scheduling conference with counsel through the actual mediation session and post-mediation communications, Jim handled the matter fairly and even-handedly. As a mediator, James Keneally uses over thirty years of litigation experience to help parties resolve complex and emotional litigation matters. Mr. Keneally’s mediation experience includes commercial matters; employment matters; FLSA and New York State Labor Law litigations; federal employment discrimination matters; and consumer complaint and fraud matters.Mr. Keneally serves as a court appointed mediator in the Commercial Divisions of the New York State Supreme Courts in New York, Queens and Nassau Counties.  He also serves on the mediation panel of the United States District Court for the Southern District of New York, the Nassau County Bar Association’s mediation panel, and as a volunteer mediator with the Better Business Bureau. Additionally, Mr. Keneally is a FINRA arbitrator and mediator. Mediation Approach & Philosophy

My role as a mediator is to help the parties understand that ultimately their dispute will be translated into, and resolved by, a monetary value. To accomplish this, I start by encouraging the parties to lay out their positions before one another, and to probe the emotional underpinnings of those positions. After the parties have had a sufficient opportunity to be heard, I caucus with them separately so that we can have frank discussions regarding the strength s and weaknesses of the parties' positions.
