Mediation Approach & Philosophy
My role as a mediator is to help the parties understand that ultimately their dispute will be translated into, and resolved by, a monetary value. To accomplish this, I start by encouraging the parties to lay out their positions before one another, and to probe the emotional underpinnings of those positions. After the parties have had a sufficient opportunity to be heard, I caucus with them separately so that we can have frank discussions regarding the strength s and weaknesses of the parties' positions.
Representative Cases Handled as a Mediator
Mr. Keneally has successfully resolved: a dispute between a leasing analysis and audit company and a large healthcare entity; a lawsuit between a printing and media company and an independent sales agent; a construction dispute between a general contractor and subcontractor; and numerous employer-employee disputes.
Fees
$250/hour minimum; fixed fees and other arrangements are negotiable

From the scheduling conference with counsel through the actual mediation session and post-mediation communications, Jim handled the matter fairly and even-handedly. He was always readily available to address issues as they arose. By his gracious tone and friendly manner, he instilled confidence in counsel and the parties that he was "hearing" their positions and understood them. He quickly grasped both the law and facts involved, and picked up very astutely on the "personal dynamics" of the party principals. Given my very positive experience with Mr. Keneally, I would not hesitate to select him as a mediator on my next case.
This testimonial was reported by James Keneally on behalf of Howard J. Burns, Esq. ., 2018I recently represented the plaintiff in a New York State Supreme Court matter. This was a case of an employer seeking repayment for advances made to an independent salesman. Mr. Keneally was both amiable and professional in arranging dates, explaining procedures and setting down guidelines for submission of papers and documents. At the actual hearing he demonstrated the highest quality negotiation and settlement skills in helping us reach a settlement. Both the setting and the support that he provided at this hearing were superior.
This testimonial was reported by James Keneally on behalf of Kenneth Sugarman, Esq.., 2018I had the pleasure of working with Mr. Keneally when he mediated a matter wherein I represented the defendant in a commercial litigation. From the outset Mr. Keneally was the consummate professional. Mr. Keneally worked to insure that the parties made incremental progress towards a resolution during our first mediation conference. And he was successful in mediating the matter to a disposition that each party could be satisfied with at the first mediation conference.
This testimonial was reported by James Keneally on behalf of Patrick Foster, Esq.., 2018James did a tremendous job helping to resolve an FLSA case where there was tremendous hostility between the parties, b/c of counterclaims alleging theft from the employer's store. James did an admirable job calming tensions, and moving the parties towards a resolution. He was also patient and willing to listen to both side. I highly recommend.
