Description of Practice
I am a former attorney with over 26 years of experience in law. Available to mediate, business, civil and family disputes. My mediation method is a hybrid The of facilitative, transformative, and evaluative. The focus of the mediation will be for the parties to communicate and work through their differences and reach a result that both parties can live with. I ,as the mediator, will only step in to guide you through the process and to keeping the mediation process proceeding and only stepping in an evaluative role when it is necessary move the process along or resolve the dispute . My mediation philosophy is that the mediation belongs to the parties to reach their own decisions and to resolve their own conflict, disputes and issues and move on in their lives and avoid a judge, jury or other decision maker make an order or judgment that does not satisfy either party. The goal of my mediation process is first to settle the case, but if the case does not settle to give the parties at the end of a mediation session, a road map to settlement of the controversy, knowledge of the obstacles of settlement, ways the parties can overcome those obstacles and leave the parties with the satisfaction that their viewpoints, positions and interests have been thoroughly discussed and considered by all sides at the mediation session I do not force or coerce a party to accept a settlement, but through discussion of the facts and evidence of the controversy and the interests of the parties bring the parties together to a settlement. THE MEDIATION SESSION Open the mediation as a group first to explain the mediation process, and then to discuss the case as a group to determine where the parties agree on facts and law, and to narrow the issues in controversy. Then, I will caucus with each side individually and discuss the strengths and weakness of their case, determine from the discussions with the parties what are the obstacles to settlement, and make suggestions for formulas to reach a settlement, and when asked and when it is appropriate, I will make a mediator’s settlement proposal. The goal of my mediation process is first to settle the case, but if the case does not settle to give the parties at the end of a mediation session, a road map to settlement of the controversy, knowledge of the obstacles of settlement, ways the parties can overcome those obstacles and leave the parties with the satisfaction that their viewpoints, positions and interests have been thoroughly discussed and considered by all sides at the mediation session.
